This is a standard-form set of booking terms drafted for Heaven Backwater Cruise, covering how
bookings, payments, and cancellations generally work for a boat tour operator. It is a starting point,
not legal advice — please review and adjust it (especially the cancellation window and refund
percentages) to match your actual policy before relying on it.
These terms apply whenever you book a cruise, boat ride, or related service (a “Package”)
with Heaven Backwater Cruise (“we”, “us”, “our”), whether by phone,
WhatsApp, or through this website.
Bookings
- A booking is confirmed once we acknowledge it and, where payment is required in advance, once
that payment is received.
- Prices shown on the Site are indicative starting rates per package and may vary with group size,
season, and boat availability; we'll confirm the exact amount before you pay.
- Bookings can be made by paying the full package price, or a booking deposit, with the balance
payable directly to us on the day of your cruise unless agreed otherwise.
Payments
- Online payments are processed securely by PayU. We do not see or store your card, UPI, or bank
details.
- You are responsible for entering accurate contact and payment details. We are not responsible for
delays or issues caused by incorrect information you provide.
- A successful online payment does not itself guarantee boat/slot availability for your chosen date
and time; we will contact you to confirm the exact schedule.
Cancellations & refunds
Unless we've agreed something different with you in writing:
- Cancellations made 48 hours or more before your scheduled cruise are eligible for
a full refund of any amount paid.
- Cancellations made 24–48 hours before are eligible for a 50% refund.
- Cancellations made less than 24 hours before, or no-shows, are not eligible for a
refund.
- If we need to cancel or reschedule your cruise (for example, due to weather, tides, or safety
conditions), you can choose a full refund or a rescheduled date at no extra cost.
- Approved refunds are returned to the original payment method via PayU and may take a few business
days to reflect.
On the day
- Please arrive at the agreed time; late arrival may shorten your cruise duration or require
rescheduling, depending on boat availability.
- Life jackets are mandatory for all passengers and will be provided.
- Children must be supervised by an accompanying adult at all times.
- We may refuse boarding to anyone who appears intoxicated or whose behaviour could endanger
themselves or others.
- Cruise routes, duration, and timing may be adjusted for safety reasons, including weather and
water conditions, at the operator's discretion.
Liability
We take reasonable care to operate safely, but boating involves inherent risks. To the extent
permitted by law, we are not liable for personal injury, loss, or damage arising from circumstances
outside our reasonable control, or for loss of personal belongings during your cruise. Nothing in
these terms limits liability that cannot be excluded under Indian law.
Changes to these terms
We may update these terms from time to time. The “Last updated” date at the top of this
page shows the latest revision. Terms in effect at the time of your booking will apply to that
booking.
Governing law
These terms are governed by the laws of India, and any disputes will be subject to the jurisdiction
of the courts in Thiruvananthapuram, Kerala.
